Court Allows NMA Challenge to Government Land Grab in Arizona

The U.S. District Court for the District of Arizona yesterday rejected the government’s motion to dismiss the National Mining Association’s (NMA) challenge to the Department of the Interior’s (DOI) more than one million acre withdrawal of land from mining in Arizona. The government aggressively argued that NMA lacked standing to bring the lawsuit, but the court found that NMA’s claims were ripe and that the association has standing to raise our constitutional challenge as well as our claims arising under the National Environmental Policy Act (NEPA). ...
